The parents, however,\u00a0objected to treatment based on an underlying belief that the child would suffer.\u00a0 Princess Margaret Hospital believed it was in the best interests of the child that he have the standard treatment and applied to the Court to make this order.<!-- \/wp:paragraph --><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9aea6e8 elementor-widget elementor-widget-heading\" data-id=\"9aea6e8\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<style>\/*! elementor - v3.9.0 - 06-12-2022 *\/\n.elementor-heading-title{padding:0;margin:0;line-height:1}.elementor-widget-heading .elementor-heading-title[class*=elementor-size-]>a{color:inherit;font-size:inherit;line-height:inherit}.elementor-widget-heading .elementor-heading-title.elementor-size-small{font-size:15px}.elementor-widget-heading .elementor-heading-title.elementor-size-medium{font-size:19px}.elementor-widget-heading .elementor-heading-title.elementor-size-large{font-size:29px}.elementor-widget-heading .elementor-heading-title.elementor-size-xl{font-size:39px}.elementor-widget-heading .elementor-heading-title.elementor-size-xxl{font-size:59px}<\/style><h3 class=\"elementor-heading-title elementor-size-default\">Background<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c0a7ed0 elementor-widget elementor-widget-text-editor\" data-id=\"c0a7ed0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>5-year-old Oshin became ill sometime in November 2015.\u00a0 The parents took Oshin to the doctors on several occasions and were referred to the Princess Margaret Hospital (\u201cPMH\u201d).\u00a0 Oshin was severely ill and medical tests revealed that he had a brain tumour.<\/p>\n<p>The medical advice to the parents was that Oshin required urgent surgery to attempt to remove the brain tumour.\u00a0 The parents accepted this advice and consented to surgery.\u00a0 On 3 December 2015 Oshin underwent surgery to remove the brain tumour.\u00a0 The surgery removed the bulk of the brain tumour but there were side effects.\u00a0 The parent\u2019s found the side effects and impact of the surgery on Oshin to be very troubling and they had concerns about the amount of time it took for Oshin to recover.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5232a3a elementor-widget elementor-widget-heading\" data-id=\"5232a3a\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Parents Refusal for Standard Treatment<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9773cb0 elementor-widget elementor-widget-text-editor\" data-id=\"9773cb0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>During Oshin\u2019s recovery from the surgery, it was recommended that he receive treatment including both chemotherapy and radiotherapy.\u00a0 However, Oshin\u2019s parents disagreed with this course of action based on Oshin\u2019s reaction to the surgery.\u00a0 The PMH referred the matter to an Ethics Committee for further consideration and direction.<\/p>\n<p>The Ethics Committee advised that its decision had to reflect what was in the best interests of the child.\u00a0 It concluded that at times it might be necessary to limit parental autonomy to act in the best interests of the child. \u00a0 To assist in considering what was in the best interest of a child, the committee proposed that decisions should be based on the burdens and benefits of treatment to the child.<\/p>\n<p>On 16 February 2016 and 17 March 2016 Oshin underwent medical resonant imaging.\u00a0 The observations from these procedures revealed that the brain tumour was proceeding in a linear path rather than spreading in an explosive like pattern.\u00a0 Based on this information, the doctors involved in Oshin\u2019s treatment concluded a standard\u00a0approach to treatment was appropriate rather than a palliative approach. Without this treatment, the Committee thought that Oshin would die.<\/p>\n<p>Based on this advice and the parents continuing refusal to consent for Oshin to receive treatment, the PMH commenced proceedings for a court to determine what is in the best interests of the Oshin.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-46920c6 elementor-widget elementor-widget-heading\" data-id=\"46920c6\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Court\u2019s Jurisdiction<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c9a7cfb elementor-widget elementor-widget-text-editor\" data-id=\"c9a7cfb\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<!-- wp:paragraph -->\n<p><!-- wp:paragraph --><\/p>\n<p>In order to decide upon the matter before it, the court must have jurisdiction.\u00a0 Oshin\u2019s parents were not married and were in a de facto relationship.\u00a0 In the WA jurisdiction, de facto matters are dealt with under the <em>Family Court Act 1997<\/em>\u00a0(the \u201cAct\u201d) of Western Australia and not the Commonwealth <em>Family Law Act 1975<\/em>.<\/p>\n<p><!-- \/wp:paragraph --> <!-- wp:paragraph --><\/p>\n<p>Section 132 of the Act provides that a court has jurisdiction under the Act to make orders relating to the welfare of the child and that regard must be had to the best interests of the child as the <em>paramount consideration<\/em>.\u00a0 The judge continued on to say these provision confer the <em>parens patriae<\/em> (parent of the nation) jurisdiction of the Western Australia Supreme Court on the Family Court of Western Australia.<!-- \/wp:paragraph --><\/p>\n<!-- \/wp:paragraph -->\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-56ec7c5 elementor-widget elementor-widget-heading\" data-id=\"56ec7c5\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Who Make Bring an Action in the Best Interests of a Child?<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0038d35 elementor-widget elementor-widget-text-editor\" data-id=\"0038d35\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><!-- wp:paragraph --><\/p>\n<p>According to section 185(2) of the Act, the following people may apply to the court for it to exercise its jurisdiction to act in the best interests of the child:<\/p>\n<p><!-- \/wp:paragraph --> <!-- wp:list {\"ordered\":true} --><\/p>\n<ol><!-- wp:list-item -->\n<li>either or both parents;<\/li>\n<!-- \/wp:list-item --> <!-- wp:list-item -->\n<li>the child;<\/li>\n<!-- \/wp:list-item --> <!-- wp:list-item -->\n<li>a grandparent; or<\/li>\n<!-- \/wp:list-item --> <!-- wp:list-item -->\n<li>any other person concerned with the care, welfare or development of the child.<\/li>\n<\/ol>\n<p id=\"block-7655030d-15ad-471e-9a89-ebe880a13299\" class=\"block-editor-rich-text__editable block-editor-block-list__block wp-block is-multi-selected is-partially-selected wp-block-paragraph rich-text\" role=\"document\" contenteditable=\"true\" aria-multiline=\"true\" aria-label=\"Block: Paragraph\" data-block=\"7655030d-15ad-471e-9a89-ebe880a13299\" data-type=\"core\/paragraph\" data-title=\"Paragraph\" data-empty=\"false\"><!-- \/wp:paragraph --><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- \/wp:paragraph --><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-094b9ae elementor-widget elementor-widget-heading\" data-id=\"094b9ae\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Court\u2019s Approach to Order Treatment for Child with Life-Threatening Cancer<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c5a1d99 elementor-widget elementor-widget-text-editor\" data-id=\"c5a1d99\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><!-- wp:paragraph --><\/p>\n<p>The evidence provided to the court based on expert medical opinion was that Oshin\u2019s chances of survival if immediate curative treatment was provided could be:<\/p>\n<p><!-- \/wp:paragraph --> <!-- wp:list {\"ordered\":true} --><\/p>\n<ol><!-- wp:list-item -->\n<li>If only chemotherapy was provided, 30% after five years; and<\/li>\n<!-- \/wp:list-item --> <!-- wp:list-item -->\n<li>If both chemotherapy and radiotherapy were provided, 50% after five years.<\/li>\n<!-- \/wp:list-item --><\/ol>\n<p><!-- \/wp:list --> <!-- wp:paragraph --><\/p>\n<p>The Court referred to the High Court case of <em>Department of Health and Community Services v JWB and SMB<\/em> (1992) 175 CLR 218 (\u201cMarion\u2019s Case\u201d) for assistance in its determination.\u00a0 This case found that parents have an implicit power to consent to medical treatment for a child incapable of providing consent.<\/p>\n<p><!-- \/wp:paragraph --> <!-- wp:paragraph --><\/p>\n<p>The Court also referred to the case of <em>Minister for Health v AS<\/em> (2004) 29 WAR 517, and the decision in that case that \u201cprotection of the child should be evaluated above all other interests, although those other interests should not be disregarded\u201d and that the court\u2019s power should be exercised \u201cwith great caution\u201d.<\/p>\n<p><!-- \/wp:paragraph --> <!-- wp:paragraph --><\/p>\n<p>The Court considered that while parents almost always act in the best interests of a child, they may face great difficulty is seeing beyond the immediate circumstances of the child to the long term future especially when faced with such difficult circumstances.<\/p>\n<p><!-- \/wp:paragraph --> <!-- wp:paragraph --><\/p>\n<p>In this case, Oshin faced certain death if he did not receive treatment.\u00a0 If he did receive the treatment he had a 50% chance of surviving the past 5 years and potentially being cured.\u00a0 The Court determined that it would be in the best interests of Oshin that he undertake the standard curative approach of treatment.\u00a0 The Court found that \u201cthe prospect of the long-term cure is the matter that must most heavily weigh in the decision\u201d.<!-- \/wp:paragraph --><\/p>\n<p><!-- \/wp:paragraph --><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Keywords:
